An Owners Corporation was faced with a recalcitrant lot owner who had accumulated approximately $17,000 in unpaid owners corporation fees for three properties in the same owners corporation. Despite numerous attempts to recover the debt through polite communications via phone and email, and formal reminders via emails and phone calls, the owner remained unresponsive and failed to settle the outstanding amount.
VCAT Judgment Obtained
The Owners Corporation, represented by Stratabase, initiated a claim at the Victorian Civil and Administrative Tribunal (VCAT). After presenting evidence of the unpaid fees and the owner’s lack of response, VCAT issued a formal judgment in favour of the Owners Corporation for the full amount outstanding.
Repeated Attempts to Contact the Debtor Ignored
Following the judgment, Stratabase continued to reach out to the owner with reminders and demands for payment. We also spoke to the managing agent who was at least communicating with the recalcitrant owner. Unfortunately, these efforts were ignored, forcing the Owners Corporation to take further action to enforcement of the judgement.
Garnishee Order Application
With the VCAT judgment in hand and no voluntary payment forthcoming, Stratabase applied to the Magistrates’ Court for a garnishee order—an enforcement tool that allows recovery directly from a third party who owes money to the debtor.
In this case, the owner’s rental income was targeted as the garnishee debt. Stratabase completed the necessary garnishee order forms and affidavit which were filed with the court, accompanied by the relevant filing fees of approximately $93.
Garnishee of Rent Payments
Upon court approval, a garnishee order was served on the real estate agent managing rent payments on behalf of the owner. The agent was legally compelled to redirect rent payments to the Owners Corporation until the debt was fully paid.
This garnishee order effectively bypassed the uncooperative owner and secured the outstanding fees. The payments were made in instalments through the garnishee process, ensuring the Owners Corporation recovered its $17,000 judgment debt despite the owner’s earlier non-compliance.
Lessons and Legal Context
Garnishee orders are a powerful enforcement mechanism post-judgment allowing creditors to collect debts from monies owed to debtors by third parties, including salary, bank accounts, or rental income. In Victoria, the Magistrates’ Court oversees garnishee applications following tribunal or court judgments like VCAT.
This case highlights the importance of persistence in debt recovery for owners corporations and demonstrates how leveraging legal instruments like garnishee orders can achieve results when debtors ignore standard recovery efforts.
This case exemplifies a practical route for owners corporations to enforce unpaid fees – obtain a formal VCAT judgment, attempt contact, then pursue garnishee orders to recover funds held by third parties such as landlords or employers of the debtor.
